ARTICLE 1 – SCOPE OF APPLICATION
These General Terms and Conditions of Sale (GTCS) apply without restriction or reservation to all sales concluded by the Seller ("TYKEIDA") with non-professional buyers ("the Clients" or "the Client") wishing to purchase the items offered for sale ("the Products") on the website www.tykeida.com.
TYKEIDA has a general obligation to provide information to its Clients, in accordance with Article L.111-1 of the French Consumer Code.
These General Terms and Conditions of Sale (GTCS) contain all pre-contractual information that TYKEIDA must provide to its Client, including payment terms, delivery times, the right of withdrawal and any other relevant information. They are intended to inform the Client of their rights and obligations, thereby ensuring informed consent.
These General Terms and Conditions of Sale (GTCS) include the General Terms and Conditions of Use (GTCU) as well as the Legal Notices of the website.
These GTCS are subject to the provisions of Article L.221-11 of the French Consumer Code.
Before using the website www.tykeida.com, we recommend that you carefully read these terms and conditions.
These GTCS are available at any time on the website www.tykeida.com and shall prevail over any other document.
TYKEIDA reserves the right to modify these GTCS at any time. Clients are advised to regularly consult the GTCS, as only the version in force at the time the order is placed shall apply.
The Client declares that they have read these GTCS and accepted them by ticking the box provided for this purpose before proceeding with the order validation process.
If the Client refuses to accept the GTCS and the data protection policy, TYKEIDA recommends that they do not use the website.
Unless proven otherwise, the data recorded in TYKEIDA’s computer systems constitutes proof of all transactions concluded with the Client.
ARTICLE 2 – WEBSITE PRESENTATION & PURPOSE
TYKEIDA is an online store specializing in the sale of ready-to-wear clothing, jewelry, shoes and fashion accessories.
The website www.tykeida.com allows the Client to purchase Products, subject to availability of stock.
The essential characteristics of the Products, such as their specifications, illustrations and information regarding dimensions or capacity, are detailed on the website www.tykeida.com. It is the Client’s responsibility to review this information before placing any order.
The choice and purchase of a Product are entirely the responsibility of the Client.
ARTICLE 3 – ACCESSIBILITY & CUSTOMER ACCOUNT
The website www.tykeida.com is accessible continuously, 24 hours a day and 7 days a week.
However, TYKEIDA reserves the right to temporarily suspend access to the website for maintenance purposes or in the event of force majeure.
To place an order, the Client must create an account. The Client is required to register by completing the form provided during the ordering process and to provide accurate and truthful information regarding their identity and contact details, including their email address and phone number.
The Client is responsible for keeping this information up to date and may modify it at any time by logging into their account.
To access their personal account and order history, the Client must log in using their username and password, which are strictly personal. The Client agrees not to disclose them and remains solely responsible for their use in the event of any breach of this obligation.
The Client may also request to unsubscribe by accessing the dedicated page in their personal account or by sending an email to TYKEIDA. The deletion request will become effective within a reasonable period of time.
In the event of non-compliance with these General Terms and Conditions of Sale, TYKEIDA reserves the right to suspend or close a Client’s account after sending a formal notice by email that remains unanswered.
The deletion of an account, regardless of the reason, results in the removal of all personal information relating to the Client.
TYKEIDA cannot be held responsible for website or server malfunctions resulting from force majeure, nor for interruptions or modifications related to maintenance operations.
Creating an account implies acceptance of these General Terms and Conditions of Sale.
ARTICLE 4 – PRODUCTS
The Products offered for sale are those displayed on the website www.tykeida.com, subject to availability of stock. Product inventory and availability are updated automatically and in real time. However, errors may occur. TYKEIDA reserves the right to modify its Product offering and/or prices at any time.
Despite careful stock management, it is possible that a Product ordered may no longer be available. In this case, TYKEIDA undertakes to inform the Client by email as soon as possible and to cancel the order concerned, with a full refund.
If an order contains several Products and one of them is out of stock, the Client will be offered the choice between a full refund of the order or the possibility of receiving the available Products. In the latter case, the refund will only apply to the unavailable Product, and the amount refunded will correspond to the price paid for that Product. If this Product was on sale or benefited from a discount, the refund will be based on the actual price paid (except in specific cases, see Article 7).
Each Product available on www.tykeida.com is presented with photographs or illustrations and accompanied by a detailed description of its main characteristics. These visual and descriptive elements are prepared with the greatest care in order to provide a faithful representation of the Products offered. However, due to differences in screen displays, variations in color, texture or perception may occur. Likewise, technical adjustments or manufacturing changes may result in slight differences compared to the images or descriptions provided.
TYKEIDA strives to ensure the most accurate presentation possible but cannot be held responsible for minor differences that do not affect the essential characteristics of the Product.
ARTICLE 5 – PRICES
The Products are offered at the prices applicable on the website www.tykeida.com at the time the order is registered by TYKEIDA.
Prices are indicated in Euros (€), excluding taxes (HT). VAT is not applicable pursuant to Article 293B of the French General Tax Code (CGI).
As a micro-enterprise, we are not subject to VAT on our sales, in accordance with Article 293B of the French General Tax Code (CGI). However, we would like to point out that this situation may change if our tax status evolves or if legislation requires us to collect VAT.
TYKEIDA undertakes to inform its Clients of any changes regarding the application of VAT and to provide all necessary information concerning any possible adjustment to invoices.
The displayed prices include any discounts granted by TYKEIDA. These prices are final and cannot be modified during their validity period. The price applicable to the Client is the one displayed at the time the order is validated.
Prices may vary depending on the geographical area due to shipping costs. Our deliveries to Europe include a Colissimo tracked and signed delivery service to ensure that your order arrives safely and within the best possible timeframe.
The prices mentioned do not include delivery costs, which will be charged additionally depending on the total order amount and the delivery method selected. These costs will be clearly indicated before the order is validated.
After the order has been validated, the Client will receive a confirmation email detailing the price of each item as well as the applicable delivery charges.
An invoice will be issued by TYKEIDA and provided to the Client. For environmental reasons, the invoice will primarily be sent by email to the address provided by the Client when placing the order. However, if the Client prefers to receive a paper invoice, it may be sent upon request at no additional cost inside the package. The Client must indicate this request in the comments field when placing the order. Once the order has been validated, this request can no longer be made unless additional fees are paid.
ARTICLE 6 – ORDERS
6.1 – Order Information
The Client is responsible for selecting the Products they wish to order on the website www.tykeida.com.
To place an order, the Client selects one or more Product(s) from our online catalogue, depending on available stock. The Client may also select the quantity, color and size (where these options are available).
The Client clicks on “Add to cart” (Products added to the cart are not reserved until the order has been completed and paid for).
It is the Client’s responsibility to check the Products in their cart and make any necessary changes (size, quantity, etc.). If desired, the Client may add “special instructions regarding the order” (such as gift wrapping, a personalized label, or sending a paper invoice).
The Client confirms that they have read and accepted the General Terms and Conditions of Sale (GTCS) by ticking the box “I accept the GTCS”.
The Client must provide a valid email address and may choose to subscribe to our Newsletter by ticking the corresponding box.
The Client then selects the shipping option, either delivery to their address or delivery to a pick-up point, and enters their valid details (country, name, address, postal code, city). The Client may also provide their first name and phone number. The Client may save their details for a future order, but it is their responsibility to check and update them if necessary. These details are required to process the order.
The Client selects their shipping method from the available options (see Article 6.2):

Delivery to a pick-up point
A summary of the order is displayed, including the list of selected items, their prices, subtotal, delivery charges and total amount. The Client may enter a promotional code or use a gift card.
The Client then enters their payment information (bank card, PayPal or gift card) (see Article 6.3).
The Client must also select a billing address, which may be identical to or different from the delivery address.
After this step, the Client can review their order summary, payment information, delivery details and personal information. If satisfied, the Client confirms the order by clicking the “Pay now” button.
Once payment has been validated, the order is considered confirmed and a detailed summary is displayed.
A confirmation email is sent to the Client containing the order number, ordered items, quantities, delivery address, shipping method and the information relating to the selected pick-up point or delivery address.
When the order is shipped, an email is sent to the Client containing a tracking link allowing them to follow the delivery of their parcel.
For any questions or issues concerning an order, the Client may contact customer service by email.
6.2 – Delivery
The Products ordered by the Client are currently delivered to the following countries:
France (Metropolitan France), Belgium, Luxembourg, Spain, Italy, Portugal, Germany, the Netherlands, Austria, Denmark, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Slovenia, Romania, Finland, Sweden, Greece, Bulgaria and Croatia.
TYKEIDA offers several delivery methods allowing the Client to receive their order according to their preference. Each delivery method has its own price. Delivery costs are not covered by TYKEIDA and will appear in the shopping cart at the time of payment.

Delivery costs are free from ninety euros (€90) of purchases. The discount will be automatically applied in the shopping cart.
The shipping fees applied by TYKEIDA cover all costs related to the shipment: carrier fees, logistics, as well as mandatory contributions.
The Customer may choose the delivery option that best suits their needs, depending on their preferences regarding delivery speed and method of receipt.

Delivery consists of the transfer to the Customer of the physical possession or control of the Product. Unless otherwise specified, Products ordered will be delivered in a single shipment.
Once the order has been confirmed, a preparation period is required before shipment. TYKEIDA generally processes orders within 24 to 48 hours. However, during periods of high activity (new collections, sales, end-of-year holidays, etc.), this timeframe may be extended.
Orders are prepared from Monday to Friday (excluding holidays and annual closure periods).
In the event of holidays or annual closure, the website www.tykeida.com will remain active. However, a clear notice will be displayed on the website and TYKEIDA’s social media pages to inform Customers of the date when order processing and shipping will resume.
Once the order has been shipped, a confirmation email containing the tracking number will be sent to the Customer. Delivery times then depend on the carrier.
Delivery times are provided for information purposes only. If the Products ordered have not been delivered within thirty (30) days after the indicative delivery date, for any reason other than force majeure, holidays, annual closure, or the Customer’s own actions, the sale may be cancelled at the Customer’s written request under the conditions provided for in Articles L216-2, L216-3 and L241-4 of the French Consumer Code. Any amounts paid by the Customer will be refunded no later than fourteen (14) days following the date of termination of the contract.
Deliveries are carried out by an independent carrier, to the address provided by the Customer when placing the order, provided that the carrier can easily access this location.
The Customer is invited to check the condition of the package and its contents upon receipt, either in the presence of the delivery person or when collecting the parcel from a pick-up point. In the event of damage caused during transport, the Customer should refuse the parcel whenever possible and immediately contact TYKEIDA customer service to report the incident and the reason for refusal.
In the event of a delivery delay caused by circumstances beyond TYKEIDA’s control, the Customer must contact TYKEIDA as soon as possible. TYKEIDA will make every effort to find a solution and minimise the impact of the delay. In the event of an incorrect delivery address provided by the Customer, TYKEIDA cannot be held responsible for the non-receipt of the parcel.
If delivery fails (absence of the recipient, failure to collect the parcel from a pick-up point), the parcel will be returned to TYKEIDA. Upon receipt, TYKEIDA will contact the Customer by email to inform them. Any reshipping costs will be borne by the Customer. In the event of a refund request, the Customer may exercise their right of withdrawal for a refund (see Article 7).
Any complaint relating to parcel delivery must be addressed to the carrier within three (3) days following delivery, in accordance with Article L133-3 of the French Commercial Code. The Customer may request delivery to an address other than their own from the carrier. However, delivery cannot be guaranteed in cases of force majeure, transport strikes, or postal service disruptions.
Any complaint concerning a delivery issue or a non-conforming Product must be submitted upon receipt and within a reasonable timeframe. In the event of a lack of conformity, the two (2)-year legal guarantee applies in accordance with Article L217-3 of the French Consumer Code (see Article 8).
TYKEIDA reserves the right to request that the Customer return any non-conforming or damaged Product.
The Customer has fourteen (14) days from delivery to submit complaints by email or post. After this period, and if these formalities have not been followed, the Products will be deemed compliant and free from apparent defects, and no complaint may be validly accepted by TYKEIDA (see Articles 7 and 8).
Delivery shall be considered completed once the tracking information indicates that the parcel has been delivered.
Home delivery: In the event of absence, a delivery notice will be left, allowing the Customer to collect the order from the nearest post office within the period indicated by the postal services.
SIZE EXCHANGE (SIZE ONLY):
Return shipping costs are free in the event of a size error, subject to stock availability.
Return and reshipment are free (same model, same colour).
If the requested size is no longer available, the Customer may choose between a refund or a store credit.
Return shipping costs are also covered when the same item has been ordered in multiple sizes to allow fitting at home. However, the initial delivery costs remain non-refundable.
EXCHANGE FOR A DIFFERENT ITEM:
Exchanges are not possible for changing the model or product reference.
A standard return is required: the item must be in perfect condition, with the tag attached.
Return costs are at the Customer’s expense unless a store credit is requested.
Once the return has been received, the Customer may choose between:

a refund (return costs deducted)

a store credit (return costs covered).
The Customer may then place a new order.
Initial delivery costs are not refunded and are not included in the store credit.
REFUND:
A return label will be sent by email.
Return costs: €5.90 will be deducted from the refund amount.
If the Customer exercises their legal right of withdrawal within the 14-day period, the standard delivery costs paid at the time of purchase will be refunded in accordance with the applicable Consumer Code. Any additional costs resulting from a more expensive delivery method than the standard delivery option remain the Customer’s responsibility.
Return costs remain payable by the Customer when they choose a refund. When using the TYKEIDA return label, an amount of €5.90 corresponding to the return shipping costs will be deducted from the refund.
STORE CREDIT:
A return label will be sent by email.
Store credit for the full value of the returned item (return shipping costs covered).
Valid with no expiry date, non-refundable, issued in the Customer’s name and non-transferable (cannot be transferred to another person).
When a store credit is requested, return shipping costs are covered. The store credit corresponds to the value of the returned item and any refundable delivery costs in accordance with applicable law.
UNCLAIMED PARCELS:
If you do not collect your parcel within the period specified by the carrier, it will automatically be returned to us.
Failure to collect a parcel does not automatically constitute a cancellation request or a refund request. If you wish to exercise your right of withdrawal, please contact us so that your request can be processed in accordance with applicable legal provisions.
In the event of a refund, the actual costs incurred for the return of the parcel may be deducted where these correspond to applicable return shipping costs.
No automatic reshipment of the parcel will be made. A new order must be placed in order to receive the items again, subject to stock availability.
DELIVERY ADDRESS:
Please carefully check your delivery address (or pick-up point) when placing your order.
The Customer is responsible for the accuracy of the delivery information provided at the time of purchase.
In the event of an incorrect address provided during the order process, any costs resulting from this error (reshipment, return, etc.) shall be borne by the Customer.
If the parcel is lost or delivered to an incorrect address due to an error made by the Customer, the Customer must contact the delivery provider directly for any claim.
If you notice an error before your order has been processed, please quickly send an email to contact@tykeida.com with the correct address or chosen pick-up point.
Once the order has been processed and the tracking number has been sent by email, we can no longer modify the delivery address. The Customer must contact the delivery provider directly.
ITEMS NOT ELIGIBLE FOR RETURN FOR HYGIENE REASONS:
For hygiene reasons, earrings and piercings cannot be returned or exchanged after delivery, except in the event of a confirmed defect.
Other jewellery and accessories may be returned under the usual return conditions, provided that they are unworn, unused, clean and returned in their original condition.
RETURN PERIOD:
14 days after receipt of the order.
The item must be unworn, unwashed, unused, with the original tag attached, and returned in its original condition.

Please provide your order number and specify whether you would like an exchange, a refund, or store credit.
We will send you the return label and instructions.
6.3 - Payment Terms
Payment is made through a secure payment system (PayPal or Shopify Payments).
The Customer must pay the full amount of the order at the time the order is placed.
Payment information is transmitted in encrypted form, in accordance with the security protocol established by the approved payment service provider used for banking transactions on the website www.tykeida.com.
Payments made by the Customer shall only be considered final once TYKEIDA has effectively received the amounts due.
TYKEIDA is not required to deliver the Products ordered if the Customer has not paid the full price under the conditions mentioned above.
TYKEIDA offers two secure payment methods:
Secure payment via PayPal:
The Customer may choose the “PayPal Payment” option and will be redirected to PayPal’s secure interface to complete the purchase. If the Customer does not have a PayPal account, they will have the option to create one before completing the payment.
Secure payment by Credit Card (via Shopify Payments):
TYKEIDA accepts payments by credit card, Visa, MasterCard, American Express, Shop Pay and Apple Pay. After selecting this option, the Customer must enter their banking information (card number, expiry date and security code).
Once payment has been validated, the order is recorded and becomes final.
In the event of fraudulent use of a bank card, the buyer may request cancellation of the payment and reimbursement of the amounts charged by contacting their bank.
After payment, a confirmation email containing the order details will be sent to the Customer.
6.4 - Order Refusal & Modification
TYKEIDA reserves the right to remove a Product from the website at any time and to modify its description.
In the event of a technical error on the website (such as an incorrect display of prices or available quantities), TYKEIDA reserves the right to cancel an order.
If an obvious error is found in the price displayed on the website (unreasonably low or unrealistic price), TYKEIDA also reserves the right to cancel the order. The Customer will be informed as soon as possible and will receive a full refund if payment has already been made.
An order may be refused if it is placed by a Customer who has previously been involved in a payment dispute or who does not comply with these Terms and Conditions of Sale. In the event of abusive returns, TYKEIDA reserves the right to refuse to process future orders from the Customer.
If an order is cancelled by TYKEIDA and payment has already been made, the Customer will be fully refunded as soon as possible using the original payment method.
If the Customer notices an error in the information provided (delivery address or billing address), they must contact TYKEIDA by email as soon as possible. A modification may be made provided that the order has not yet been processed and shipped.
Any request to cancel an order cannot be accepted once the order has already been processed and shipped. In this case, the Customer must exercise their right of withdrawal once the parcel has been received (see Article 7).
If, despite all our precautions, an item is defective or incorrect upon receipt of the parcel, the Customer must contact TYKEIDA by email, specifying their order number. TYKEIDA undertakes to process the request as quickly as possible.
In the event of a defective Product, the legal guarantees shall apply in accordance with Articles L217-4 to L217-16 of the French Consumer Code and Articles 1641 to 1649 and 2232 of the French Civil Code relating to hidden defects (see Article 8).
ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) working days from receipt of their order to exercise their right of withdrawal, without having to provide any reason or pay any penalties.
To be valid, the request must be submitted within the fourteen (14) working day period.
This period begins on the date the Customer physically receives the order. After this period has expired, the sale shall be considered final.
To exercise their right of withdrawal, the Customer must inform TYKEIDA of their decision without delay by means of a clear statement expressing their wish to withdraw, sent by post to TYKEIDA or by email for faster processing, using the contact details provided above.

IMPORTANT!!
Please note that returns must never be sent to the registered office address:
60 rue François 1er, 75008 Paris.
This address does not process customer returns and is only used for receiving letters and administrative correspondence. Any parcel sent to this address will be refused and returned to the Customer at their own expense.
Please contact us by email before sending any return. No return will be accepted without our prior approval.
Once the return has been approved, you must send the parcel to the return address provided by TYKEIDA (see Articles 7.1 and 7.2).
RETURN ADDRESS
Please contact us and we will provide you with the return address.

Returns may also be sent via Mondial Relay. Please specify this when requesting a return, and we will provide you with the appropriate pick-up point to send the parcel.
TYKEIDA may advance the return shipping costs. If the Customer is unable to create a return label, one may be sent by email. The corresponding amount will then be deducted from the refund.
If the Customer chooses to create their own shipping label, they must provide TYKEIDA with the tracking number. This applies whether the return is sent via Mondial Relay or the postal service.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL:
In accordance with Article L.221-28 of the French Consumer Code, certain Products cannot be subject to the right of withdrawal.
In particular: sealed goods that have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection (earrings, piercings, bodysuits, underwear, swimwear, hair accessories, hats, beanies, caps, socks).
Products that are damaged, dirty, incomplete, or that have absorbed odours (make-up, cigarette smoke, perfume, etc.) will not be accepted for return.
Shoes must be returned in their original condition, with the soles in perfect condition and without any signs of wear. Customers are advised to try on shoes on a clean surface in order to preserve their condition.
If the return conditions are not met, the return will be refused and the Customer will be contacted to arrange a new shipment at their expense. If a returned item has been damaged or shows signs of prolonged use, no refund will be issued and the reshipping costs for returning the item to the Customer will be payable by the Customer.

7.1 - Return of the Entire Order
In the event that the Customer exercises their right of withdrawal for the entire order:
RETURN OF PRODUCTS:
In accordance with Article L.221-23 of the French Consumer Code, the Customer must return the Products in new condition, unused and in their original packaging, allowing them to be resold as new, no later than fourteen (14) days after receipt of the Products (see exceptions to the right of withdrawal).
RETURN COSTS:
Return costs are the responsibility of the Customer, in accordance with Article L.221-23 of the French Consumer Code, except as otherwise stated above.
However, if TYKEIDA agrees to advance these costs, a prepaid return label will be provided to the Customer, and the amount will be deducted from the refund issued.
CUSTOMER RESPONSIBILITY WHEN RETURNING PRODUCTS USING THEIR OWN SHIPPING METHOD:
If the Customer chooses to return the Product using their own shipping method, they must use a delivery service with tracking. Indeed, until the returned Product has been received by TYKEIDA, the Customer remains responsible for the Product until its actual receipt, in accordance with Article L.221-23 of the French Consumer Code.
In the event of loss, theft, or damage to the Product during transport, the Customer must contact the carrier directly. TYKEIDA cannot be held responsible for incidents occurring during transport, and no refund request may be made to TYKEIDA in this regard.
REFUND:
In the event of withdrawal, TYKEIDA will refund all amounts paid by the Customer, including standard delivery costs. However, if the Customer has chosen a more expensive delivery method than the standard delivery option offered by TYKEIDA, the additional cost will not be refunded.
If return costs advanced by TYKEIDA apply, their amount will automatically be deducted from the refund.
The refund will be issued within fourteen (14) days from receipt of the withdrawal request, subject to TYKEIDA receiving the returned Products or the Customer providing proof of shipment.
The refund will be made using the same payment method used for the original order, unless otherwise agreed between the parties.
7.2 - Partial Return of the Order
In the event that the Customer exercises their right of withdrawal for only part of the items in an order containing several Products:
REFUND:
Only the price of the returned Product will be refunded, provided that it is returned in new condition, unused, and in its original packaging (see exceptions to the right of withdrawal).
The refund will be issued within fourteen (14) days from receipt of the withdrawal request, subject to TYKEIDA receiving the returned Products or the Customer providing proof of shipment.
The refund will be made using the same payment method used for the original order, unless otherwise agreed between the parties.
ADJUSTMENT OF DISCOUNTS:
If a discount was applied based on the number of items purchased, the refund amount will be recalculated accordingly. Therefore, if the return of one or more items results in the loss or modification of the initial discount, the price of the retained items will be adjusted according to the applicable pricing conditions without the discount, and the refund amount will be corrected accordingly.
INITIAL DELIVERY COSTS:
In accordance with Article L.221-24 of the French Consumer Code, standard delivery costs are only refunded if the entire order is returned. If the Customer keeps part of the items, these costs remain payable.
ADJUSTMENT OF DELIVERY COSTS:
If the Customer benefited from a delivery discount or free delivery due to the total amount of their order, and the return of one or more items causes the total amount to fall below the required threshold for the discount, the initial delivery costs will be reinstated and deducted from the refund.
RETURN COSTS:
In accordance with Article L.221-23 of the French Consumer Code, return costs are the responsibility of the Customer. If TYKEIDA agrees to advance these costs, a prepaid return label will be provided and the return costs will be deducted from the refund.
CUSTOMER RESPONSIBILITY WHEN RETURNING PRODUCTS USING THEIR OWN SHIPPING METHOD:
If the Customer chooses to return the Product using their own shipping method, they must use a delivery service with tracking. Until the returned Product has been received by TYKEIDA, the Customer remains responsible for the Product until its actual receipt, in accordance with Article L.221-23 of the French Consumer Code.

ARTICLE 8 – SELLER'S LIABILITY – LEGAL GUARANTEES
The Products supplied by TYKEIDA benefit from:

The legal guarantee of conformity, for Products that are defective, damaged, or do not correspond to the order.

The legal guarantee against hidden defects resulting from a defect in materials, design, or manufacturing affecting the delivered Products and making them unsuitable for use.
Provisions relating to legal guarantees:

"The Seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. The Seller is also liable for defects in conformity resulting from packaging, assembly instructions, or installation when such installation was the responsibility of the Seller under the contract or was carried out under the Seller's responsibility."

To exercise their rights, the Customer must inform TYKEIDA in writing (by email or postal mail) of the lack of conformity of the Products or the existence of hidden defects as soon as they are discovered.
For Products covered by a guarantee and deemed non-compliant or defective, TYKEIDA will:

Refund the full price of the Product based on the invoiced price, and refund return costs upon presentation of supporting documents.

Provide a partial refund if the Customer chooses to keep the item despite the identified defect.

Replace the Product with an identical model (subject to availability).
Refunds or replacements of Products deemed non-compliant or defective will be carried out as soon as possible and no later than fourteen (14) days following TYKEIDA's confirmation of the lack of conformity or hidden defect. This refund may be made by bank transfer.
TYKEIDA's liability cannot be incurred in the following cases:

In the event of improper use, damaged Products, Products modified, repaired, or altered by the Customer. Likewise, if the Customer was aware of the defect at the time of purchase, the guarantee cannot be invoked.

Use for professional purposes, negligence, or lack of maintenance by the Customer, as well as normal wear and tear of the Product, accidents, or force majeure.
The photographs and graphics presented on the website are not contractual and cannot engage TYKEIDA's liability.
TYKEIDA's guarantee is, in all cases, limited to replacement with an identical model, subject to availability, or to a refund of Products that are non-compliant or affected by a defect.

The Customer is informed that the collection of their personal data is necessary for the sale of Products by TYKEIDA and for the transmission of such data to third parties for the purpose of delivering the Products. This personal data is collected solely for the performance of the sales contract.
